1

Our Commitment to Copyright

Cineby respects the intellectual property rights of copyright owners, studios, distributors, and creators worldwide. We comply with the Digital Millennium Copyright Act (DMCA) and respond to valid takedown notices in accordance with its provisions. If you are a copyright owner or their authorized agent and believe that content indexed or accessible through Cineby infringes your copyright, you may submit a DMCA takedown request following the procedure described on this page.

2

How to Submit a DMCA Takedown Notice

To submit a valid DMCA takedown request, your notice must be in writing and must include all of the following information. Incomplete notices cannot be processed.

Your full legal name and complete contact information (mailing address, telephone number, and email address).
A clear description of the copyrighted work you claim has been infringed, with enough detail to identify it (e.g., title, year, studio).
The exact URL or URLs on Cineby where the allegedly infringing content appears. General descriptions without specific URLs cannot be acted upon.
A statement made in good faith that you believe the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on their behalf.
Your physical or electronic signature.

Where to Send Your Notice

Submit your complete DMCA notice through our Contact page. When filling out the contact form, please select "DMCA / Copyright" as the subject. Include all required information listed above in the message body.

Notices that do not include all required elements, or that do not clearly identify the infringing content via specific URLs, may not be processed. Please ensure your notice is complete before submitting.

4

Response Time and Process

We process all complete and valid DMCA notices as quickly as possible. You should typically receive an acknowledgement within 2 to 5 business days of receiving a properly completed notice. Upon verification of a valid claim, we will take appropriate action to remove or disable access to the allegedly infringing content indexed on Cineby.

Because Cineby does not host the video content itself, our response involves removing the content listing from our index. To ensure complete removal of the infringing file from the internet, you should also contact the third-party hosting servers directly.

5

Counter-Notification

If you believe content was removed from Cineby as a result of a mistake or misidentification, you may submit a counter-notification. A valid counter-notification must include:

  • Your name, address, telephone number, and email address
  • Identification of the content that was removed and where it appeared before removal
  • A statement under penalty of perjury that you believe the content was removed as a result of mistake or misidentification
  • Your physical or electronic signature

Counter-notifications should be submitted through the same Contact page with the subject "DMCA Counter-Notice".

6

Repeat Infringers

Cineby has a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers of intellectual property rights. Because Cineby does not require user accounts, this policy applies to access restrictions for IP addresses or other technical identifiers associated with repeat infringement activity.

7

False DMCA Notices

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees. Only submit a DMCA notice if you are the copyright owner or authorized agent and genuinely believe the identified content infringes your copyright.
